    Do Not Litigate…Mediate!

    parenting and family disputes!


    JoAnna Konogeris, MA and Cristina Barnes co-founded South Orange County Mediation after finding that not all legal problems were resolved within the courts. And often the perceived “losing” party did not comply with the orders. This lack of resolution is compounded by the fact that family matters like divorce and elder issues are emotional and are usually not served well by costly litigious battles that are win-lose and damage any ongoing relationship. These family matters are often in need of swift resolution; however, impacted court calendars for litigated cases can run into years of hearings, continuances, and ultimately trials, leading to huge financial burdens for the parties involved.

    Mediation allows for a non-adversarial resolution process. Mediation is a confidential and private process. Mediated agreements are filed with the courts and are as binding as a litigated decision. The parties do not have to air their personal matters in a public forum such as a courtroom. Your family disputes remain private and are resolved through addressing concerns and interests relevant to your particular circumstance. If you have ever been in a courtroom or party to a litigated case you may have felt the anxiety and fear of this extremely confined and formal process.

    Most people are not even aware of how the court system works and are overwhelmed and confused. In litigation there is always a winner, therefore there is always a loser. Mediation advocates win – win outcomes for both parties. Skilled mediators facilitate clear communication by helping the parties transition from adversarial roles to collaborative participants in determining their best outcomes, thereby creating a better future for themselves and their family. Parties who choose to mediate recognize that it is in their best interest to create their own customized agreement making it more likely to be adhered to.
